This notice explains how Adv Michelle Ives collects, uses and protects personal information, in line with the Protection of Personal Information Act 4 of 2013 (POPIA). It applies to this website, the enquiry form, and communication with chambers by email, telephone and WhatsApp.
1. Who we are
The responsible party is Adv Michelle Ives, Advocate of the High Court of South Africa, practising as a referral advocate from Eagle Canyon Office Park, 4958 Jan Frederick Avenue, Randpark Ridge, Roodepoort, 2158.
Information Officer: Adv Michelle Ives · michelle@milegal.co.za · 010 443 8822
2. Information we collect
- Enquiry form: your name, surname, email address and phone number.
- Email, telephone and WhatsApp: your contact details and whatever you choose to send.
- Website use: limited technical information such as your IP address, browser type and pages visited, collected by the website host and any cookies described in section 8.
Please do not send details of a criminal matter through this website. Information about a matter should come to chambers through your instructing attorney.
3. Why we use it
Personal information is processed only for a lawful purpose (section 11 of POPIA) and only as far as necessary to:
- respond to enquiries from attorneys and others who contact chambers;
- accept, manage and carry out briefs, and keep the related records;
- invoice instructing attorneys and keep financial records;
- comply with legal and professional obligations, including those under the Legal Practice Act and the rules of the Legal Practice Council; and
- keep this website secure and working properly.
Your details are never sold, and are not used for direct marketing.
4. Information in briefs
Briefs from attorneys may contain special personal information, including information about alleged criminal behaviour, and information about children. This is processed only as necessary to establish, exercise or defend a right or obligation in law, as permitted by POPIA (including section 27(1)(b)), and is treated as confidential and privileged.
5. Sharing
Personal information is shared only where needed for the purposes above, with:
- the instructing attorney, the courts, and other parties to proceedings as the law requires;
- service providers who support the practice, such as website hosting, email, IT and accounting. They act as operators under written agreements that require them to keep the information secure and confidential; and
- regulators or authorities where the law requires disclosure.
6. Transfers outside South Africa
Some service providers, such as email and cloud storage providers, may store information on servers outside South Africa. Where this happens, information is transferred only in line with section 72 of POPIA, to providers bound by laws or agreements that give it a level of protection substantially similar to POPIA.
7. Security and retention
Reasonable technical and organisational measures are in place to prevent the loss, misuse or unauthorised access of personal information. These include access controls, password protection and secure storage of physical files.
Enquiries that do not lead to a brief are deleted after six months. Records relating to briefs are kept for as long as the law and professional rules require, and are then securely destroyed.
8. Cookies
This website uses cookies it needs to work and stay secure. With your consent, it also uses analytics cookies from Google Analytics (Google) and Jetpack Stats (Automattic) to understand how visitors use the site, and a language cookie if you use the translation tool.
You can accept or decline non-essential cookies in the cookie banner, and block or delete cookies in your browser settings.
9. Your rights
Under POPIA you have the right to:
- ask whether we hold personal information about you, and request access to it;
- ask for it to be corrected, or deleted where there is no longer a lawful reason to keep it;
- object to its processing, on reasonable grounds;
- withdraw your consent where processing is based on consent; and
- complain to the Information Regulator.
To make a request, email the Information Officer at michelle@milegal.co.za. Some information, such as privileged material in a brief, may be exempt from disclosure. Requests for access are also handled under the Promotion of Access to Information Act, 2000.
